e-Evidence: Guidelines for competent judicial and law enforcement authorities of the EU

This website contains official operational instructions and technical requirements for competent judicial authorities and law enforcement authorities of the European Union Member States issuing European Production Order Certificates (EPOC) or European Preservation Order Certificates (EPOC-PR) on the basis of Union rules on e-Evidence, namely Regulation (EU) 2023/1543 and Directive (EU) 2023/1544 [Art. 1(1), 2, Art. 1(1)].
In accordance with Article 3(1), point (a) of Directive (EU) 2023/1544, home.pl sp. z o.o. designates its registered office in Szczecin (Poland) at ul. Zbożowa 4 as its sole designated establishment for the receipt of, compliance with and enforcement of certificates concerning electronic evidence [Art. 2 (5), Art. 3 (1) point (a)].
In accordance with Regulation (EU) 2023/1543, written communication between competent authorities and service providers should, as a rule, be carried out through a decentralised IT system (e-CODEX) or the central Web-based Interface for Service Providers (WISP) [Art. 19 (1), (4)].
Due to the ongoing transition period and the lack of full technical implementation of the national decentralised IT system, home.pl sp. z o.o. operates on a secure, alternative communication channel in fallback mode in accordance with Article 19(5) and Article 24 of Regulation (EU) 2023/1543. During this transition period, all certificates must be served, processed and handled via our dedicated, secure email address using alternative cryptographic means ensuring authenticity and confidentiality

In accordance with Article 10(4) of Regulation (EU) 2023/1543, EPOCs issued in emergency cases must be executed within 8 hours [Art. 3 (18), Art. 10 (4)]. Please be advised that although home.pl sp. z o.o. will take all possible and legally permissible measures to produce the requested data within the statutory deadline [Art. 10 (4)], certain categories of data must be obtained from other specialised departments whose availability outside of standard business hours may be limited.
If your submission constitutes a valid emergency case – in addition to sending an email to the dedicated address, you are required to immediately contact our 24/7/365 emergency helpline at: +48 504 502 500 in order to trigger the necessary response procedures on our side.In order to guarantee immediate identification of the submission, the subject line of the email must strictly include the label "Emergency Case". This description may only be used if the conditions specified in Article 3, point (18) of Regulation (EU) 2023/1543 have actually been met.
Submissions that do not meet these requirements may be classified and processed under the standard procedure.
In accordance with Article 4(2) of Directive (EU) 2023/1544, home.pl sp. z o.o. officially declares Polish as the sole legally binding language for the receipt and processing of e-Evidence requests. English is accepted as an auxiliary (additional) language only. Any European Production Order Certificate (EPOC) or European Preservation Order Certificate (EPOC-PR) issued in a language other than Polish must be accompanied by a proper translation into Polish, in accordance with Article 9(4) of Regulation (EU) 2023/1543.
